1. Acceptance of Terms

By accessing or using Take3.live ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you are using the Platform on behalf of a school or athletic program, you represent that you have the authority to bind that organization to these terms. If you do not agree, please do not use the Platform.

2. Eligibility and Account Registration

  • The Platform is intended for use by school administrators, coaches, and athletic staff who are at least 18 years of age.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete information when registering your account.
  • Each account must represent a real individual. Shared accounts are not permitted.

3. Student Data and FERPA Compliance

By entering student athlete information into the Platform, you represent and warrant that:

  • You are an authorized school official with a legitimate educational interest as defined under FERPA (20 U.S.C. § 1232g).
  • You have the authority to enter and manage student athlete records on behalf of your school or program.
  • Your use of the Platform complies with your school's FERPA obligations, including obtaining any required parental consents.
  • You will promptly notify us if you become aware of any unauthorized access to or disclosure of student data.
  • You will not enter sensitive student data beyond what is necessary for athletic program management (name, grade, weight class, athletic record).

4. COPPA Compliance

In compliance with the Children's Online Privacy Protection Act (COPPA):

  • Student athletes under 13 may not create accounts or directly submit personal information to the Platform.
  • All student athlete data must be entered by authorized adult school personnel (coaches, administrators).
  • As a school official, you are responsible for obtaining any parental consents required under COPPA before entering student data.
  • We rely on schools and coaches as the responsible party for compliance with COPPA when entering minor student information.

5. Permitted Use

You may use the Platform to:

  • Manage your school's wrestling roster and athlete records
  • Schedule and manage wrestling meets and tournaments
  • Record and track match scores and statistics
  • Share meet information and live scores with spectators

You may not use the Platform to:

  • Enter false, fraudulent, or misleading information
  • Access or attempt to access other users' accounts without authorization
  • Use the Platform for any commercial purpose unrelated to athletic program management
  • Scrape, harvest, or collect data from the Platform through automated means
  • Violate any applicable laws or regulations

6. Data Ownership

You retain ownership of all data you enter into the Platform, including student athlete records. By using the Platform, you grant us a limited license to store and process that data solely to provide the services described herein. We do not claim ownership of your data and will return or delete it upon request.

7. Public Information

Live meet scores and results may be accessible to the public via shareable scorebook links. By sharing these links, you acknowledge that match results (including wrestler names and scores) will be publicly visible. You are responsible for determining whether sharing such information is appropriate for your program and compliant with your school's policies.

8. Intellectual Property

The Platform, including its design, features, and underlying code, is owned by Take3.live and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our express written permission.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Use of the Platform is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Take3.live shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Platform, including any loss of data. Our total liability to you for any claims shall not exceed the amount you paid us in the twelve months prior to the claim.

11. Indemnification

You agree to indemnify and hold harmless Take3.live and its officers, directors, and employees from any claims, losses, or damages (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any applicable law, including FERPA or COPPA.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, misuse of the Platform, or for any other reason at our discretion, with or without notice. You may delete your account at any time by contacting us at support@take3.live.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts of jurisdiction.
